In Germany, there is extensive legislation and regulations governing the wearing of protective clothing such as protective suits, head coverings, or gloves. The legislature has set clear guidelines for the use of protective clothing to ensure the health and safety of workers.
In particular, the Occupational Safety and Health Act (ArbSchG) forms the basis. Although it does not contain specific paragraphs on protective clothing, § 3 paragraph 1 ArbSchG states that the employer must take the necessary measures to ensure the safety and health protection of the workers. This also includes the provision and wearing of protective clothing.
Additionally, the regulations of the professional associations play a role. The German Social Accident Insurance (DGUV) issues rules and regulations, for example, the DGUV Rule 112-189 "Use of Protective Clothing". This provides specific instructions on equipping with and using protective clothing.
The Operational Safety Regulation (BetrSichV) and the PPE User Regulation (PSA-BV) are other important laws regulating the wearing of protective clothing.
Protective clothing differs from conventional work clothing in its specific protective character. It is designed to protect the wearer from specific hazards that can occur in the work environment. This can include protection from chemical substances, high temperatures, electrical voltage, falls, and other specific dangers. In contrast, work clothing serves more for identification and protection from general workplace risks.
In conclusion, the wearing of protective clothing in Germany is strictly regulated by a combination of laws, regulations, and the rules of the DGUV. It is the employer's responsibility to provide a safe working environment and ensure that workers have the correct protective clothing.
